State Mandate ACA Reporting Requirements for 2024
When Congress eliminated the federal individual mandate penalty under the Affordable Care Act on January 1, 2019. Some states such as California, District of Columbia, Massachusetts, New Jersey, Rhode Island, Vermont have implemented the individual mandate at the state level, which requires its residents to have the Minimum Essential Coverage for each month of the calendar year or pay the State tax penalty.
So, in addition to ACA reporting to the IRS, now in or out of state employers who employ those state residents must submit their employees’(residents) health coverage information to the state through the ACA Forms and MA Form 1099-HC and furnish copies to their employees before the deadline to avoid unwanted penalties.
ICHRA Reporting on ACA Forms
As of January 1, 2020, ICHRA (Individual Coverage Health Reimbursement Arrangement) is an alternative option for employers from the traditional group health plan. This allows employees to purchase their individual health insurance plans and health care services that best
fit their needs.
In turn, the plan reimburses the employee up to their allowance amount. These reimbursements amounts are tax-free for both the employers and employees. So, any employers who offered ICHRA plans to their employees in the tax year 2023 must submit their ICHRA coverage information to the IRS through Form 1095 and furnish copies to employees in the year 2024 ACA reporting.
